PERSONAL INFORMATION

“Personal Information” shall mean the information which identifies the User, name, identification number, email address, age, gender, or phone number provided to VariClass^TM at the time of registration or any time thereafter. Personal information may include “sensitive personal information or data” as defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and in this context, includes passwords or any financial account information provided by you during registration. We request you to not provide us with any Personal Information unless specifically requested by us. In such events where you provide us information not required by us or not requested by us, we bear no liability to such Personal Information provided by you.

INFORMATION WE COLLECT

The Application/Website/Services/products records the information you provide when you download and register on the Application for Services or products.

CONTACT INFORMATION

When you register with us, we generally collect your name and/or your ward’s name, age, email address, phone number, password and your ward’s educational interests/education qualifications, bank details. We also collect identification information to enable us to check and verify your identity such as Aadhaar details and unique identifiers, such as username or password.

BILLING INFORMATION

Billing Information, such as debit card number, credit card number and billing address.

USER INFORMATION

We might collect information related to your purchases, response to any offers, or download or use of applications from us or interaction with our customer service, participation in surveys or marketing promotions.

OTHER INFORMATION

If you use our website, we may collect Information you provide us when you contact us for help. In addition, the Application/products/Services may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application/Services/products. As is true for most Mobile applications VariClass also collects other relevant information as per the permissions that you provide.

GENERAL
PRIVILEGED/EXCLUSIVE SERVICE

By having a VariClass account, you have explicitly given consent for us to capture images (followed by analysis), camera/mic permissions to arrange video calls and record the same. You have also given permission that such recording be accessed to establish conduct in class for teaching, learning, content, and behaviour.

USE OF COOKIES

VariClass can use technologies such as cookies, clear gifs, log files, and flash cookies for several purposes, including to help understand how you interact with our website and services, to provide a better experience.

REVISION OF TERMS & GRIEVANCE REPORTING

We will review this Privacy Policy from time to time to make sure it is up to date. If you are just a visitor, then please note that this Privacy Policy is subject to change at any time without notice. To make sure you are aware of any changes, please review this Policy periodically. If you are our registered user, we will notify you before we make changes to this Policy and give you the opportunity to review the revised Policy before you choose to continue using our services. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified Terms of this Website.

SHARING OF INFORMATION WITH THIRD – PARTIES

VariClass uses an outside third-party payment processing company to bill you for the goods and services availed by you. These companies do not retain, share, store or use personally identifiable information of you for any other purpose. We will share information with third parties who perform services on our behalf and our business partners. We share your information with our trusted services providers who work on our behalf, do not have an independent use of the information VariClass discloses to them, and have agreed to and adhered to the rules set forth in this Policy. We may disclose information if we think we must comply with the law. We will share information to respond to a court order or subpoena or investigation.

DISCLOSURE OF PERSONAL INFORMATION

VariClass may disclose personal information

• As required by law, such as to comply with a subpoena (Written order to attend any law authority to give evidence), or similar legal process.
• May also share it if a government agency or investigatory body requests.
• We might also share information when we are investigating potential fraud, or any criminal activity being run on our website by any user.
• To enforce applicable ToU/T&C (Terms of Use or Terms & Condition), including investigation of potential violations thereof.
• When we believe in good faith (doctrine of uberrima fides) that the disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, address security or technical issues or respond to a government request.
• With our trusted service providers who work on our behalf and do not have an independent use of the information we disclose to them and have agreed to and adhered to the rules set forth in this Policy
• To protect against imminent harm to the rights, property or safety of the Application/Website or our users or the public as required or permitted by law.
• With third party service providers to personalize the Application/Website/Services/products for a better user experience and to perform behavioral analysis.
• Internally with the relevant departments to facilitate payments of salary, deduction of taxes, procuring medical insurance, etc.
• User's full name and his/her display picture can be publicly displayed on the Website as part of any promotion or content.

The Terms of Use Agreement is incorporated herein by reference in its entirety.

GOVERNING LAW AND JURISDICTION

In the event of any dispute arising between the parties with respect to this Agreement, the same shall be referred to the Sole Arbitrator and the arbitration shall be in accordance with Arbitration and Conciliation Act of 1996. The language of arbitration proceedings shall be English. The seat and place of arbitration shall be Delhi and the decision of the Arbitrator shall be final and binding on both parties herein This contract shall be subject to the exclusive jurisdiction of courts Delhi, India and shall be governed by the Indian laws.
